اعتبر الممثل الأعلى للشؤون الخارجية للمجلس الدولي لحقوق الإنسان (IHRC)، المعتمد من الأمم المتحدة بصفة خاصة لدى المجلس الاقتصادي والاجتماعي (ECOSOC)، ورئيس بعثته إلى جنيف، الدكتور هيثم بو سعيد، خلال متابعته لجلسات الدورة الثالثة والستين، أن المعطيات التي خرجت بها أمس لجنة تقصي الحقائق التابعة للأمم المتحدة بشأن الأوضاع في سوريا تمثل تطوراً بالغ الخطورة، مؤكداً ضرورة البناء عليها من أجل ضمان حقوق جميع الضحايا وعائلات من فقدوا ذويهم، ووضع حد لحالة الإفلات من العقاب.

‎وأضاف الدكتور بو سعيد، في بيان لوكالة الأنباء الدولية لحقوق الإنسان، أن ما سبق أن أوردته اللجنة من وقائع ومؤشرات، إلى جانب المعطيات الجديدة، يثير مخاوف جدية من أن بعض الانتهاكات والجرائم المرتكبة قد ترقى إلى مستوى جرائم حرب وجرائم ضد الإنسانية وفقاً لمعايير القانون الدولي.

‎وأشار إلى أن ما ظهر أمس بشأن المظالم والانتهاكات التي طالت السكان في السويداء والساحل والمنطقة الشرقية من سوريا يؤكد أن الملف لم يُغلق، وأن الوضع الإنساني والحقوقي لا يزال يعيش حالة من “النزيف المستمر”، في ظل ما وصفه بعجز مؤسسات الدولة الحالية عن توفير حماية شاملة وتحقيق عدالة ناجزة وفعالة لجميع المتضررين، بصرف النظر عن هويتهم أو انتمائهم.

‎وأكد بو سعيد أن العدالة الانتقائية ما زالت تمثل جوهر المشكلة، معرباً عن شكوك جدية في مدى جدية الإدارة المؤقتة في دمشق في محاسبة جميع المسؤولين عن الانتهاكات، ومشيراً إلى أن أسباب ذلك قد تتراوح بين غياب الإرادة السياسية، أو اعتبارات أيديولوجية وفقهية داخل بعض مكونات الإدارة، أو عدم القدرة الفعلية على القيام بالواجبات المنوطة بها. وشدد على أن أياً من هذه الأسباب لا يمكن أن يشكل مبرراً قانونياً للتقاعس عن حماية المدنيين أو ملاحقة مرتكبي الجرائم.

‎وانتقد الدكتور بو سعيد ما وصفه بعدم تطابق رد ممثل سوريا مع حجم وخطورة الوقائع الميدانية، معتبراً أن الرد لا يرقى إلى مستوى المسؤولية المطلوبة، وأن محاولة تجاوز الحقائق أو الالتفاف عليها لا يمكن أن تنهي ملفاً موثقاً أمام المؤسسات والآليات الدولية.

‎وأضاف أن الإدارة القائمة في دمشق، بحسب ما يتابعه مكتبه، لم تُظهر حتى الآن إجراءات جدية وشفافة، سواء كانت قضائية أو أمنية، تتناسب مع حجم الانتهاكات المبلغ عنها، لافتاً إلى أن أشخاصاً قيل إنهم خضعوا للمحاسبة أو إن هناك نية لمحاسبتهم ظهروا لاحقاً بين الناس من دون إجراءات واضحة أو رقابة فعالة.

‎واعتبر أن استمرار هذا النهج يمثل استخفافاً بالالتزامات والمعايير الدولية، ويعكس، وفق تقديره، عدم إعطاء الآليات الدولية الخاصة بالمحاسبة والعدالة الوزن المطلوب، والاكتفاء بإجراءات محدودة لا تعالج جوهر المشكلة.

‎وختم الدكتور بو سعيد بالتأكيد أن المساعي التي قام بها مكتبه ويتابعها عن كثب تتجه إلى نقل هذا الملف إلى الجهات القضائية والأمنية الدولية المختصة، بما يتيح وضع اليد على الوقائع والأدلة واتخاذ الإجراءات المناسبة وفقاً لمبادئ القانون الدولي ومعايير العدالة والمساءلة، وبما يضمن للضحايا وذويهم حقهم في معرفة الحقيقة والوصول إلى العدالة والإنصاف.

‎Dr. Haissam Bou Said, High Representative for External Affairs of the International Human Rights Council (IHRC), accredited to the United Nations in a special ECOSOC capacity and Head of its Mission to Geneva, said while following the proceedings of the 63rd session that the findings and information presented yesterday by the United Nations Fact-Finding mechanism concerning the situation in Syria constitute a highly serious development.

‎He stressed that these findings must be built upon in order to ensure the rights of all victims and the families of those who have lost their loved ones, while bringing an end to the prevailing climate of impunity.

‎In a statement issued to the International Human Rights News Agency, Dr. Bou Said said that the facts and indicators previously presented by the Commission, together with the latest findings, raise serious concerns that certain violations and crimes committed in Syria may amount to war crimes and crimes against humanity under international law.

‎He noted that the information presented yesterday concerning grievances and violations affecting civilians in Sweida, the Syrian coastal region and eastern Syria demonstrates that the matter remains unresolved. He described the humanitarian and human rights situation as one of “continued bleeding”, amid what he characterized as the inability of the current state institutions to provide comprehensive protection and deliver effective and prompt justice to those affected, regardless of identity or affiliation.

‎Dr. Bou Said further stressed that selective justice remains at the heart of the problem, expressing serious doubts about the willingness of the interim administration in Damascus to hold all those responsible for violations accountable. He said the reasons may include a lack of political will, ideological and doctrinal considerations among certain elements within the administration, or an actual inability to discharge its responsibilities. None of these factors, he stressed, can constitute a legal justification for failing to protect civilians or pursue perpetrators of serious crimes.

‎Bou Said also criticized what he described as the failure of the Syrian representative’s response to reflect the gravity of the realities on the ground, arguing that the response falls short of the level of responsibility required. Attempts to evade or obscure established facts, he said, cannot bring an end to a matter that remains documented before international institutions and mechanisms.

‎He added that, according to his office’s monitoring, the administration in Damascus has yet to demonstrate serious and transparent judicial or security measures commensurate with the scale of the reported violations. He further noted that individuals reportedly subjected to, or allegedly facing, accountability have subsequently been seen moving freely in public without clear legal measures or effective oversight.

‎Dr. Bou Said considered the continuation of such practices to constitute disregard for international obligations and standards and, in his assessment, a failure to give appropriate weight to international accountability and justice mechanisms.

‎He concluded by stressing that the efforts undertaken by his office, which he continues to follow closely, are moving toward referring the file to the competent international judicial and security authorities, with the aim of ensuring that the relevant facts and evidence are properly examined and that appropriate measures are taken in accordance with international law and recognized standards of justice and accountability.

‎He emphasized that victims and their families must be guaranteed their fundamental rights to truth, justice and effective remedy.
